These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Thayu Labs Ltd (“Thayu Labs,” “we,” “us,” or “our”), a company registered in Kenya with its principal office in Nairobi.
By downloading, installing, or using any of our mobile applications (collectively, “Apps”), you agree to be bound by these Terms. If you do not agree, do not use our Apps.
2. Description of Services
Thayu Labs develops and maintains the following mobile applications:
- Sentii: A personal finance management application offering transaction tracking, budget management, savings goals, bill reminders, AI-powered spending insights, and data export capabilities.
- Thimo: A cultural preservation application featuring a curated collection of Kikuyu proverbs with translations, daily discovery, and social sharing.
- Nyimbo Cia Ngai: A hymn companion application providing searchable hymn lyrics, favourites management, and offline access for worship.
- Muse: An ambient wisdom application that displays curated quotes and wisdom content on idle screens.
- Resonance: An AI-powered emotional companion that matches quotes and reflections to your current emotional state.
3. User Accounts and Cloud Sync
Certain features of our Apps require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Cloud sync is an optional feature that allows you to back up and synchronise your data across multiple devices. When enabled, your data is transmitted to and stored on our cloud infrastructure (powered by Supabase) using encrypted connections. You may disable cloud sync at any time.
4. Subscription Terms
4.1 Freemium Model
Our Apps operate on a freemium model. Free tier users have access to core functionality with the following limitations:
- Maximum of 1 savings goal (Sentii)
- Maximum of 2 category budgets (Sentii)
- Maximum of 3 bill reminders (Sentii)
- Limited insights and analytics
- Advertisements displayed after a 40-day introductory period
4.2 Premium Subscriptions
Premium subscriptions unlock unlimited access to all features, including unlimited savings goals, category budgets, bill reminders, full analytics, receipt OCR, split transactions, PDF export, and an ad-free experience.
Subscription pricing:
- Monthly: $4.99/month (or regional equivalent)
- Annual: $29.99/year (or regional equivalent)
4.3 Billing and Renewal
Subscriptions are processed through Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
4.4 Cancellation
You may cancel your subscription at any time through your device's app store settings. Upon cancellation, you will retain premium access until the end of the current billing period. After expiration, your account will revert to the free tier. All your data will be preserved; free-tier limits apply only to the creation of new items.
4.5 Free Trials
A 7-day free trial may be offered during the onboarding process for new users. If you do not cancel before the trial ends, you will be automatically charged for the selected subscription plan.
5. Intellectual Property
All content, features, functionality, design, code, graphics, logos, and trademarks in our Apps are owned by Thayu Labs Ltd and are protected by international copyright, trademark, and other intellectual property laws.
The Kikuyu proverbs presented in Thimo are part of the public cultural heritage of the Kikuyu people. Our curation, translations, commentary, and presentation are proprietary.
6. User Content and Data Ownership
You retain full ownership of all data you input into our Apps, including financial records, journal entries, mood logs, custom categories, and personal preferences. We do not claim any ownership rights over your content.
You grant us a limited licence to process your data solely for the purpose of providing, maintaining, and improving our services. This licence terminates when you delete your data or account.
7. Prohibited Uses
You agree not to:
- Use our Apps for any unlawful purpose or in violation of any applicable laws.
- Reverse engineer, decompile, or disassemble any part of our Apps.
- Attempt to gain unauthorised access to our systems or other users' data.
- Use automated systems or bots to access our Apps.
- Interfere with or disrupt the integrity or performance of our Apps.
- Circumvent any content protection, access controls, or usage limits.
8. Disclaimers
Financial Disclaimer (Sentii): Sentii is a personal finance tracking tool and does not constitute financial advice. AI-generated insights are for informational purposes only. We are not a licensed financial advisor, bank, or investment service.
AI Content Disclaimer (Resonance): AI-generated content in Resonance is intended for personal reflection and is not a substitute for professional mental health advice, diagnosis, or treatment.
General: Our Apps are provided “as is” and “as available” without warranties of any kind, either express or implied.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Thayu Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.
10. Termination
We may suspend or terminate your access to our Apps at any time, with or without cause. Upon termination, your right to use our Apps will immediately cease.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
12. Dispute Resolution
In the event of a dispute, you agree to first attempt to resolve it informally by contacting us at legal@thayu.com. If informal resolution is unsuccessful within thirty (30) days, either party may initiate formal proceedings.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated at least fifteen (15) days before they take effect.
